Welcome to RuckFit UK! this website is operated by RuckFit UK Ltd. RuckFit UK offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

 

Definitions

 

"RuckFit UK" refers to our company, its website, challenges, and retail store.

"User" refers to any individual accessing our website, using our services or purchasing our products

"Challenges" refer to the fitness events offered by RuckFit UK.

"Retail Store" refers to the online store where we sell rucking backpacks, equipment, and apparel.

 

Website Use


By visiting our site and/ or purchasing services or products from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

 

You must be at least 18 years old to use our website and services.

You agree to provide accurate and up-to-date information when using our website, including when making purchases.

You are responsible for maintaining the confidentiality of your account and password.

If we have to contact you, we will do so by writing to you at the email address you provided to us in your order, or the email address linked to your member account or the email address provided to us when you registered with RuckFit UK.

 

RuckFit UK Challenge Events - Release of Liability

 

User’s acknowledgement and assumption of risk and full release from liability of RuckFit UK:

You as the User acknowledges that the RuckFit UK Challenge Events purchased hereunder includes participation in strenuous physical activities, including, but not limited to, rucking with a weighted backpack at various speeds over varying terrain, functional fitness training, various aerobic conditioning and bodyweight movements offered by RuckFit UK (the “physical activities”).

 

Users acknowledge these physical activities involve the inherent risk of physical injuries or other damages, including, but not limited to, heart attacks, muscle strains, pulls or tears, broken bones, shin splints, heat exhaustion, knee/lower back/foot injuries and any other illness, soreness, rhabdomyolysis, or injury, however caused, occurring during or after client’s participation in the physical activities.

 

Users further acknowledge that such risks include, but are not limited to, injuries caused by the negligence of self or other person, defective or improperly used equipment, over-exertion of a client, slip and fall by client, or an unknown health problem of client.

 

Users agree to assume all risk and responsibility arising from participation in the physical activities. Users affirms that they are in good physical condition and do not suffer from any disability that would prevent or limit participation in the physical activities.

 

Users acknowledge participation will be physically and mentally challenging, and Users agrees that it is the responsibility of the User to seek competent medical advice regarding any concerns or questions concerning the ability of client to take part in RuckFit UK’s physical activities.

 

By reading this agreement, the User affirms that he or she is capable of participating in the physical activities and agrees to assume all risk and responsibilities for exceeding his or her physical limits.

 

Any person acting on behalf of User, his or her heirs, assigns and next of kin, waives any claims against and releases RuckFit UK (as well as any of its owners, directors, employees, or other authorised agents, including independent contractors) from any and all liability, claims and / or causes of action that client may have for injuries or other damages of any kind, including but not limited to punitive damages, arising out of participation in RuckFit UK activities, including, but not limited to the physical activities.

 

Users are particularly advised not to undertake strenuous physical activities for which they might be medically unfit. Users who have any reservations as to their physical condition are advised to have a full medical check-up before embarking on any exercise. The exercise programmes and facilities provided are designed with safety in mind, these are however used entirely at the Users’ own risk. All Users must complete a Par-Q health check form on our website prior to booking any service.

 

RuckFit UK Challenge Events are held in all weather conditions throughout the year. It is the Users responsibility to ensure that:

They have the correct clothing/footwear to ensure personal safety and comfort

They provide their own water to ensure they are sufficiently hydrated throughout the session / challenge

They have sunscreen/insect repellent where applicable

They bring any necessary emergency medication with them e.g., inhalers/EpiPen etc.

 

General Terms

Definitions

“Booking” means the booking on the Website, through the online booking process, of RuckFit UK Challenge Event

“Commencement Date” means the date you pay your for the Event

“Fees” means the Event Entry Fee 

“Partners” means third party businesses which assist in providing sessions or other services to our Participants (which shall include without limitation: venues, instructors, our third party payment provider, or businesses that offer discounts or other services to Members).

“Venues” means any of the venues from which RuckFit UK provides its services to Members.

“Website” or “Site” means www.ruckfituk.com

 

Event Entry Fees / Payments

Your Entry to the Event is confirmed on the Commencement Date.

You shall pay the Fees at the time of joining at the rate specified by RuckFit UK.

RuckFit UK reserves the right to amend its Fees at any time. 

All Fees paid upfront are non-refundable (save for in the sole discretion of RuckFit UK).

We may sometimes need to change times or location of sessions. If we need to do this we will, where reasonably possible, send you an email notifying you of the change or make an announcement on the Website, Facebook or via our WhatsApp group.

Participants must be over 18 years of age, unless agreed with RuckFit UK.

In order to make a Booking on the Website, you will be provided with secure access to the self-service part of the Website where you can set up a secure login with a username and password. You will be able to view Events booked as well as make additional bookings through your secure account on the website. Please ensure your log-in details are kept secure.

The use by us and our Partners of your personal data shall be in accordance with our privacy policy and any privacy policy of our Partners.

Payment for Fees is taken by a third-party payment processor. On making a Booking you will leave the Website and enter a third party’s booking engine followed by another third party’s payment website. Payment is then taken by credit or debit card or Paypal via a secure connection. RuckFit UK does not have access to your payment card details. Once you leave our website you are subject to the terms and conditions of our third-party booking engine and payment processor. We are not liable for any damage caused in relation to use of our Partner’s services.

Membership also entitles you to access to the community section on Facebook and our WhatsApp group. Please be respectful and honest in your postings on Facebook/WhatsApp. Please ensure the posts are measured and relevant to the group. We reserve the right to remove any postings that do not comply with our terms or that of Facebook’s.

We will occasionally take photographs and video footage of your participation in events and socials. As a participant you give us permission to use such images and footage for the purposes of promoting RuckFit UK services. Please inform us immediately if you do not wish us to use such images and footage in this way.

 

Liability

No advice or information provided by us or our Partners shall create any warranty or legal obligation and we make no warranty that our services shall meet your requirements or be fit for purpose.

To the maximum extent permitted by law, we and are Partners shall not be liable for any indirect, incidental or special loss, data, goodwill, whether such damage could have been foreseen or whether we were advised of the possibility of such damage or loss. We will not be liable for such losses or damage in connection with our services whether arising in contract, tort or otherwise.

Notwithstanding section 6.2 above, in the event that you suffer damage as a result of our failure to fulfil our obligations to you under this Membership Agreement or as a result of our negligent act or omission, our liability to compensate you is limited to the lesser of (i) the amount of Fees we have received from you in one year; or (ii) a reasonable sum having regard to whether the damage was caused by our negligent act or omission.

Neither us nor our Partners will be liable to you for:

Any loss or damage caused by your own fault

Any loss or damage caused by a third party unconnected with us or our Partners.

Neither us nor our Partners will be liable for any loss or damage caused to any property or personal items brought to any sessions.

Neither us nor our Partners shall be liable to you for any loss or damage caused by events outside our reasonable control (i.e. acts of terrorism, riots, floods, freak weather, snow, fire etc.)

Nothing in this section shall exclude our liability for death or personal injury caused by our negligence or any other liability not excludable by law.

You participate in all of our sessions, activities and events at your own risk.

 

Miscellaneous

No rights shall be conferred by this Agreement on any third parties (other than Partners) and the Contracts (Rights of Third Parties) Act 1999 shall not apply.

You agree to indemnify us against all liabilities, claims and expenses arising from any breach of this Agreement by you.

Your Event entry is not assignable to any third party. We may assign our obligations under this Agreement to a third party on written notice to you.

You are responsible for informing us about any changes to your personal information.

This Agreement supersedes all prior agreements between you and us and constitutes the entire agreement governing your Entry

This Membership Agreement shall be governed by English law and any disputes shall be referred to the courts of England and Wales.

Online Retail Store Terms of Service

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

 

Accuracy Of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

 

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
